usually for a personal injury case.

If you win or settle your case, the funding company gets paid back from your settlement money.
If you lose your case, you owe nothing ! They can’t demand repayment from your bank account,
paycheck, or personal assets. groceries, or cover other expenses.
So, “non-recourse” = no personal risk .

1. Apply — You fill out a short application with basic info about your lawsuit, like the type of case (car accident, slip and fall, etc.), when it happened, and your attorney’s contact info.
2. Case Review — DMS Funding reviews the details of your case.
We want to understand:
- Who’s at fault
- How strong your case is
- How much your settlement might be worth
3. Approval — If the case looks solid, we will approve you and make a funding offer, this is usually based on how much
your settlement might be.
Example: If your case is estimated to settle for $1,000,000, we may offer you $50,000–$200,000 up front.
4. Sign Agreement — You and your lawyer review and sign a funding contract.

- The fees and repayment terms
- That it’s non-recourse (you only repay if you win)
5. Get Funds — Once signed, you’ll get the money, often within 24 to 48 hours sent directly to your bank account.

No, the only parties aware of your transaction are you as the plaintiff, your attorney, and DMS Funding.
Financial
We never check your credit score. Credit is not a factor in our approval process.
In many cases, you can receive your money the same day your funding is approved. How fast we can approve your application depends on the specifics of your case and how quickly we hear back from your attorney. On average, once we speak with your attorney, the review takes about two business days.
We typically advance 10–20% of your case’s estimated value. Funding amounts usually range from $500 to $1,000,000, and in some cases, even more, depending on the strength of your case. This approach helps make sure you still receive a meaningful portion of your settlement.
The money is only paid from the proceeds of your case settlement.
You keep the money and don’t have to pay anything back.
There are no upfront fees to apply! The cost of funding depends on the details of your case. You’ll receive full pricing information once approved. Our fees are competitive, and there’s no out of pocket cost, repayment comes directly from your settlement. If you don’t win your case, you owe nothing.
After you Apply
Once you apply, you should follow these three easy steps.
1. Tell Your Attorney
Let your lawyer know you’ve applied for funding with DMS Funding. Expect them to be contacted by
DMS to:
- Confirm details about your case
- Finalize and sign the funding agreement
2. Watch Your Phone and Email
DMS Funding will send you updates about your application status. Keep an eye out for calls/texts or
emails so you don’t miss anything important.
3. Keep Your Phone On
Once your application is approved, a DMS Funding team member will call you to explain next steps, like how and when you’ll receive your money.
Let your attorney know that you’ve applied for financing with DMS Funding and that we will be contacting them to review the details of your case.
Yes! If you’ve already received funding and need additional support, you can apply again online or by
phone.
DMS Funding will:
- Review updated case information
- Get in touch with your attorney
- Send you a new agreement if approved
You and your lawyer will both need to sign before more funds are released.
